R - Potential Social Media Litigation 2026 SOL IFB 114894 Due Date: Closing On: 3/13/26 5:00 PM From time to time, the Commonwealth of Virginia, Office of the Attorney General (??OAG?) must supplement its in-house knowledge with attorneys having relevant experience and expertise in particular areas. This solicitation seeks proposals from attorneys in private practice who have expertise in the area of litigation involving social media.In accordance with Virginia Code Sections 2.2-507 and 2.2-510, the Attorney General has determined that it is impracticable or uneconomical for the OAG to render all of the legal services contemplated by this Solicitation for Proposals (??SFP?). Submission Details Submission of Proposals. Proposals responding to the needs outlined and in the manner specified in this SFP must be submitted by the deadline indicated. Each proposal shall be submitted through Responsive. Proposal Format. Proposals must conform to the following specifications: To be selected, the proposal must indicate that the offeror unequivocally agrees to the terms contained in this solicitation, including any attachments or exhibits. The offeror further acknowledges that absent extraordinary circumstances, as defined by the Office of General Counsel (??OGC?), any request for deviation from these terms or terms in the subsequent engagement, if selected, will not be honored. Trade secrets or proprietary information submitted by a firm in connection with a proposal may not be subject to the Virginia Freedom of Information Act (??FOIA?), Virginia Code Section 2.2-3700, et seq. To the extent that the offeror intends to submit proprietary, confidential, or trade secret information and claim the exemption to the FOIA statute aforementioned, the offeror shall submit such information in a separate document (attachment) from the response to the SFP and it should be appropriately labeled. Schedule.Proposals will be received until the date and time indicated in the ??Details? tab of the SFP in Responsive. There will be no exceptions. Right to Reject.The OAG reserves the right to reject any or all proposals submitted in response to this SFP. The issuance of this SFP is not a guarantee of award and the OAG reserves the right not to make any award under these terms. Ex Parte Communication.Please note that you are not authorized to contact any other OAG employee or Commonwealth personnel regarding this SFP unless and until the OAG issues a ??Notification of Award.? Failure to adhere to this requirement will result in your firm??s immediate disqualification from consideration. .Additional Information.The offeror is responsible for inquiring about and clarifying any aspect of this SFP that is not understood. It is the sole responsibility of the offeror to make itself knowledgeable of any addendum to this SFP.8.Evaluation of Proposals. The OAG will review and evaluate all proposals received in a timely manner. Proposals will be evaluated on the basis of the offeror??s qualifications under Section 4, other work experience listed if germane, and the proposal.9.Notification of Award. It is anticipated that final decisions will be issued within approximately eight (8) weeks after the closing date. Offerors will be notified through Responsive. Expectations Successful firms to this solicitation shall have:Demonstrable ExpertiseDemonstrable expertise and experience in the required subject area(s) for the relevant geographies;Proficiency in the structure and organization of public entities, e.g., hierarchy and decision-making authority.Competitive PricingCompetitive contingent fees based on the prevailing market for services of the nature requested;Innovative approaches in pricing using appropriate fee arrangements, including alternative fee arrangements where feasible.Good Relationships & Prior Track RecordEvidence of a continuous, sustained, and mutually beneficial relationships with clients;Evidence of a willingness to establish and maintain strategic relationships to help the Commonwealth achieve its objectives;A demonstrable track record of successfully delivering legal services similar to those requested by the Commonwealth.Commitment to Invest in Service Delivery and ProcessesDemonstrable investment in and continuous use of best practices in processes underpinning the firm??s delivery of legal advice;Use of appropriate technology to provide services effectively, and efficiently, to the client??s benefit;Efforts to recognize and enhance diversity and community initiatives in the firm??s resourcing.Absence of any significant conflicts preventing your firm from providing the Commonwealth with the entirety and duration of anticipated services required.Any other criteria as determined by the OAG.Scope of Work Proposal Offering and Content. The OAG is soliciting proposals from attorneys to advise and represent the OAG with respect to potential litigation involving social media companies. Counsel shall also provide additional assistance in this area of the law as requested by the Attorney General.Specification. The scope of work is expected to include, but is not necessarily limited to, the following: Analyze the viability of potential claims against social media companies arising from past and ongoing conduct. Determine the types and amounts of relief available under such claims. Work with the OAG to develop claims and theories of liability. Prosecute potential claims against social media companies, seek monetary and injunctive relief, and pursue such other relief as may be available by law.Telephone and Email Advice. Appointed counsel will be required to respond to questions raised by designated Assistant Attorneys General concerning the substantive areas identified in this SFP. Questions raised directly by client agencies will be immediately coordinated with the designated Assistant Attorneys General unless otherwise authorized by the Office of General Counsel (??OGC?).Review of Documents and Informal Advice. Periodically, Assistant Attorneys General may have documents that they would like reviewed by appointed counsel for the purpose of obtaining comments. It is contemplated that this review would not require a formal written response, but rather informal advice identifying problem areas or providing suggestions. It may be, however, that a written response is more efficient and economical and, in such event, the written response will be deemed part of routine legal advice.Building In-House Expertise. Appointed counsel may be required to assist the OAG by providing training for Assistant Attorneys General. Appointed counsel may do so by assigning a particular partner or senior associate with the appropriate expertise to provide advice in the nature of training and supervision to Assistant Attorneys General who may be working on a matter within the scope of this SFP.Litigation. Assistance in specific case litigation including, but not limited to, preparing and filing necessary pleadings, orders, etc., through final disposition. This may include appellate representationCurrent Developments. Appointed counsel shall monitor pending developments and keep the OAG abreast of significant changes and pending changes in the designated areas of law. This service, including notifications accomplished by form letter, shall be without charge.Special Projects. Special Projects may include written opinions, litigation, and all work authorized by the OGC and requested by the OAG that is not considered routine legal work. All such special projects must be coordinated through the OGC for approval prior to commencement.Request and Approval for Services. Requests for services shall initiate from the OAG rather than from the respective public client agencies, namely from Assistant Attorneys General serving discrete public bodies. In contrast, authorization to commence work on specified services originates solely from the OGC.
